CEQA APPROVALS Final Environmental Impact Report certified by San Diego County Department of Environmental Health (DEH) on February 6, 2003. CEQA Findings, Statement of Overriding Considerations and Notice of Determination issued by DEH on June 2, 2004.

SOLID WASTE FACILITY PERMIT

Issuing Agency: California Integrated Waste Management Board/San Diego County Department of Environmental Health

Process: Permit application deemed complete on April 1, 2004 by DEH. Draft permit issued and submitted for concurrence to California Integrated Waste Management Board (CIWMB) on June 2, 2004. CIWMB concurrence hearing was held December 14, 2004 and on December 22, resulted in final SWFP approval!

WASTE DISCHARGE REQUIREMENTS

Issuing Agency: San Diego Regional Water Quality Control Board

Process: Revised permit application will be submitted in January 2005 to respond to technical comments from RWQCB staff regarding the monitoring system. Staff has 30 days to deem application complete or provide additional comments. Good probability there will be completeness finding, due to nature of comments, which are primarily to seek clarification. Once deemed complete, RWQCB likely to issue final WDR’s within 140 days. Even if not issued, construction of landfill footprint including liner system may commence, if other required permits are obtained.

AIR QUALITY PERMIT

Issuing Agency: San Diego County Air Pollution Control District

Process: Expect complete permit application to be submitted in February 2005. APCD has 30 days to make completeness determination. Once permit application is submitted and deemed complete, permit issuance typically takes 4-6 months.

RESOURCE PERMITS


Including the following:
Army Corps of Engineers Dredge & Fill permit, Endangered Species Act consultation, National Historic Preservation Act consultation, California Department of Fish & Game streambed alteration agreement, Regional Water Quality Control Board Section 401 certification.

Issuing Agencies: Army Corps of Engineers, U.S. Fish & Wildlife Service, State Historic Preservation Office, California Department of Fish & Game, San Diego Regional Water Quality Control Board.

Process: Two actual permits are required – a Clean Water Act Section 404 dredge & fill permit from the Army Corps of Engineers, and the Streambed Alteration Agreement from the California Department of Fish & Game. Gregory Canyon will apply for a pre-issued Nationwide Section 404 permit from the Corps. The ancillary consultations are with the U.S. Fish & Wildlife Services on endangered species issues, and the SHPO on cultural resources issues. A RWQCB water quality certification related to the Section 404 permit will also be required. Under federal law, the endangered species consultation must be completed within 150 days of initiation.

SAN DIEGO COUNTY WATER AUTHORITY APPROVAL

Permits/Approvals: Agreement related to protection or relocation of aqueduct.

Issuing Agency: San Diego County Water Authority.

Process: The agreement is related to protection/relocation of the existing pipelines. The process should take about 3 months to complete.

ANCILLARY COUNTY PERMITS


Including the following:
Grading Permit, Demolition Permit, Bridge Permit, Water Course Alteration Permit, Habitat Loss Permit, Blasting Permit, Building Permit

Issuing Agencies: Various departments within San Diego County.

Process: These are highly technical permits, and in some cases are similar in nature to permits issued by other agencies. A substantial amount of technical work is required prior to submittal of permit applications, including detailed design drawings for the bridge and access road. Once submitted, permit process should take about three months.

SR 76 ENCROACHMENT PERMIT

Issuing Agency: California Department of Transportation

Process:This permit is required for physical access from the landfill access road onto SR 76. This permit is highly technical in nature, and would be required just before commencement of operation. Design-level drawings must be completed as part of the application.

POWER LINE RIGHT OF WAY RELOCATION; LAND CONVEYANCE

Issuing Agency: California Public Utilities Commission

Process: The Section 851 approval is required to convey the existing SDG&E power line right of way to Gregory Canyon, per the agreement between Gregory Canyon and SDG&E. The CPCN is required for the relocation of the power line to the new right of way. SDG&E will undertake the permitting process. These are technical approvals, and the permitting process takes about 1 year from submittal of the permit application.
